Agency Designation

A Customer may designate an Agent for obtaining and managing services for the Customer for a specific presently active account(s). An agent shall not be allowed to initiate a new account. If the Customer designates an Agent, the Agent shall act on behalf of the Customer for all purposes in arranging and managing services for the Customer for the specific presently active account(s). The Agent shall have on behalf of its Principle, the Customer, all rights and obligations, the Customer would have under the Company’s tariffs. The designation of an Agent shall not give the Customer or its Agent any additional rights than the Customer would have under the Company’s tariffs. The designation of an Agent shall not relieve the Customer of any obligation that it has under any tariff, including but not limited to the obligation to pay the Customer’s bill.

The Customer shall be permitted to designate only one external “mail to” recipient, such as an Agent, to receive Customer billing statements and associated correspondence for a specific account.

In order to designate an Agent, the Customer shall complete an Account Agent Designation Statement provided by the Company, and not as part of any other document. The Customer shall deliver the Statement to the Company. Upon receipt of the Statement by the Company, the Company shall recognize the Agent as the Customer’s representative. The Customer may terminate the agency relationship only by delivering to the Company a statement revoking the Agency Designation Statement. Ameren will assume this Customer-Agent relationship will remain in force until a Termination of Account Agent Designation Statement is received revoking the designation of this Agent to act on the Customer’s behalf.

The Company shall treat all representations and requests of the Agent as if made by the Customer. The Company may rely on any and all representations made by the Agent on behalf of the Customer. The Company shall not be held liable for any action taken by the Company in good faith reliance upon a representation or request made by the Agent. The Customer shall indemnify and hold the Company harmless against any claim arising out of any action that the Company takes in response to the Agent’s request.

If a Customer designates an Agent, the Company shall communicate with the Agent on all matters that it would be required to communicate with the Customer under its tariffs. The Company may also, but is not required to, communicate with the Customer directly on any matter for which it has a right to communicate with the Customer under its tariffs.
